讲座内容简介：

        Enforcement authorities in Europe, U.S., and Asia are in the process considering whether to bring competition policy cases against major Internet platforms.  This talk explores the propriety of such cases from two perspectives.  First, it offers a retrospective of the U.S. and European cases against Microsoft, which remains the leading case brought against a major high-tech platform.  Second, it conducts a tentative assessment of the current case on comparison shopping and mobile operating systems.  These examples underscore how applying competition law in an undisciplined manner can inhibit innovation without providing any benefit to consumers.

 

教授简介：

       Christopher S. Yoo 是宾夕法尼亚大学法学院的John H. Chestnut教授，亦是该校科技、创新和竞争中心的创始主任。其研究关注于用网络工程和不完全竞争的原理理解网络和知识产权的规制。他正在建立一个创新型一体化跨学科项目，旨在培养接受法学和工程学高等训练的新一代专业人才。他正在领导开展一项重要的中、美、欧竞争政策比较研究。他也是对以创新方式连接世界和网络进行实证分析的主要组织者。

       在进入学术界前，Yoo教授曾任美国联邦最高法院Anthony M. Kennedy法官和哥伦比亚特区联邦上诉巡回法院Raymond Randolph法官的助理（协助撰写法庭意见）。他曾在现任联邦最高法院首席法官John G. Roberts的指导下，在Hogan & Hartson（后为Hogan Lovells）律师事务所执业。他曾任范德比尔特大学法学院教授，负责该院的科技与娱乐法项目。Yoo教授先后毕业于哈佛学院、加州大学洛杉矶分校安德森管理学院和西北大学法学院，分获文学学士、工商管理硕士和法学博士（JD）。Yoo教授是四本书和70余篇论文、书章节的作者，并经常在国会、联邦通讯委员会（FCC）、联邦贸易委员会（FTC）和国外监管机构作证。
