Professor Ding Ding was Invited to Participate in the Forum for Comments on the Implementation Regulations on the Foreign Investment Law and other Supporting Regulations

On October 25, 2019 and November 18, 2019, Professor Ding Ding of UIBE law school has twice been invited to “The Forum of Soliciting Opinions Concerning the Implementation Regulations on the Foreign Investment Law (FIL)” and “The Forum of Soliciting Opinions Concerning the Administration of Registration of Foreign-invested Enterprises in Accordance with the Law” held by China Council for the Promotion of International Trade (CCPIT) law department and International Chamber of Commerce of China National Committee.

The October 25th forum was hosted by Shen Peilan, director of CCPIT Legal Department, Division of Regulations. Deputy director Li Wei delivered a speech. Representatives of chamber of commerce, associations and companies such as the United States Chamber of Commerce, the European Union Chamber of Commerce, French Chamber of Commerce and Industry, China-Britain Business Council, Tokai Japan-China Trade Center, COFCO, Sinochem Agrochemical Co., Ltd., Syngenta (China) Investment Co., Ltd., Jingdong Group, Tao Chemical, Walmart (China) Investment Co., Ltd., Maersk, Dell, Starbucks and lawyers from law firms such as Clifford Chance, Aaron, Haiwen and Universal attended the forum.

In combining the contents of Draft Implementing Regulations, Professor Ding Ding, as a key interpretation expert, put forward suggestions on its legislative purpose and principle, the relationship between the Draft Implementing Regulations and FIL, the principles of promoting and protecting foreign investment in accordance with domestic and foreign management, the national security review system, the specific measures to promote and encourage foreign investment, transitional period and other aspects. Professor Ding Ding also exchanged views with representatives from chambers of commerce, enterprises and law firms on the amendments of the Draft Implementing Regulations.

After the meeting, Professor Ding Ding was also invited to provide written suggestions for the amendment of the Draft Implementing Regulations to the Second Legislative Council of the Ministry of Justice and the Legal Department of CCPIT.

The November 18th forum was hosted by Zhao Ruihao, deputy director of the Legal Department of CCPIT. Professor Ding Ding provided expert advice on the allocation and clarification of the management authority of the negative list of foreign investment, the registration and reporting system of foreign investment, and the transitional period of applying the Company Law to foreign-invested enterprises.
